One Big Walk Terms and Conditions 

1.    The main objective of this agreement is to raise funds for Royal Mencap Society. Royal Mencap Society is a charity incorporated and registered in England and Wales with charity number 222377 whose registered office is at 6 Cyrus Way, Hampton, Peterborough PE7 8HP and supports people with a learning disability.

2.    This agreement is required to ensure that Mencap is compliant with charity law.

3.    You will ensure that the following information appears on all materials promoting your fundraising activity or requesting donations for Mencap:

a.    the amount going to Mencap from your activity. If you are splitting your profit between Mencap and any other charity/ies then you must set out the split and the name of the other charity/ies. The purpose of this statement is to allow the public to understand what the actual monetary contribution will be to Mencap from the fundraising activity.
b.    the words; In support of Royal Mencap Society charity incorporated and registered in England and Wales with charity number 222377;.

4.    In carrying out the fundraising activity, you agree not to do or say anything which could harm Mencap's reputation or goodwill or which might reasonably be expected to bring Mencap into disrepute.

5.    Mencap does not authorise you to act as an agent or on behalf of Mencap.

6.    We want you to enjoy yourself and be safe. Whilst we really appreciate your support, Mencap cannot be responsible for organising, supervising or hosting your fundraising activity, and all activities and participation in them are at the organisers; and participants; own risk. You agree to comply with all applicable health and safety rules, guidance and protocols (including any protocols issued in relation to COVID-19). 

7.    You understand that when participating in an event or activity you conduct your own research as to what facilities may be available. Mencap accepts no responsibility or liability for any facilities or lack of.

8.    Mencap cannot accept responsibility or liability for any loss or damage, or for any death or personal injury, arising out of any fundraising activity, including as a result of negligence (except death or personal injury caused by Mencap's negligence). You should ensure that you are fit and well enough to participate in the fundraising activity. If you are unsure of your physical ability to take part, you should seek medical advice from your doctor to ensure that you are physically fit to participate, and it is extremely important that you are realistic about your ability to participate. 

9.    We do not advise that you collect money in a public place or door to door. If you do choose to do so, you will need a license from your local authority.

10.    To help ensure your fundraising activities are in compliance with charity laws, you agree:

a.    not to engage in any activity which may, in the reasonable opinion of Mencap: 
i.    result in any unreasonable intrusion on any persons privacy; or
ii.    involve unreasonably persistent approaches to any person for the purpose of soliciting or otherwise procuring money; or 
iii.    place undue pressure on any person to give money;

b.    that any promotional material associated with your fundraising activities do not place undue pressure on any person;

c.    you will not target vulnerable people to partake in your fundraising activities; and

d.    your fundraising activities are not promoted through direct approaches to individuals either by telephone or face-to-face asks.

11.    On Mencap's request, you will provide any information or records Mencap reasonably requires to allow Mencap to assess and monitor your compliance with this agreement.

12.    If you are planning a lottery (such as a raffle or a sweepstake) or a pay-to-enter competition, you should be aware that there are strict laws about what you can do. For guidance on this please review the Gambling Commissions website at www.gamblingcommission.gov.uk

13.    If children (under 18) are involved in fundraising in any way, please make sure they have permission from their parent or guardian and are properly supervised by a responsible adult. Children should not approach strangers about fundraising.

14.    Mencap cannot provide insurance to fundraisers. You should always consider whether you need appropriate insurance cover for your fundraising activity. If necessary, consider carrying out a risk assessment and make sure participants are fully briefed about the activity. 

15.    Mencap may end this agreement at any time by writing to you, if you:
a.    fail to do anything mentioned in this agreement, 
b.    act unlawfully or infringe the rights of a third party, or
c.    do anything likely to bring Mencap into disrepute. 

16.    You agree to send to us all money relating to your fundraising activity, as quickly as possible, and in any event no later than one month after the date that your activity ends. 

17. By taking part in the event, you confirm that you are happy for your name, footage or photographs taken during your participation in the event to be used to publicise Mencap's work. Any photographs or video footage may be used on Mencap's website, materials and social media networks.
